    I am talking about a person (like 485mbe - the one who has posted next to yr post) who has a PD of 2001 ..I am not saying that they should give Eb2's quota to EB3 ..but they should try to pull the category that is worst affected..or atleast give EB3 something ..
    my question to you is ..say in the year 2010, would u support a situation where all categories are current or at 1 year difference ...while a particular category (eb3 I in this case) is at 2001 ??.. even if you do ..my feeling is that USCIS will try to pull EB3 - I (if something like above happens)..but then they are just a govt agency ..and in the end they are similar to govt agency in India ..only difference is that maybe little better
    can I force them to do something just --No. can I pray for it -- maybe ..should I be ready for it (i.e. Eb3 - still in 2001 - 2002) - definitely !!
    actually Eb3 - I should try and see something positive from this (I know it is difficult) ..maybe this long queue may motivate them to work harder or to get additional certifications (as I do ..) ...also, in my case, this delay in GC ..prevented me from buying a house when the prices were at peak ..(there is no doubt ..that had I got GC in 2006 ,..then I would have rushed to buy a house at inflated prices --far away from the city)


    Just curious, why are you not porting your PD?. Nowadays Perm takes less than 2 months and with premium, 140 takes a few months.

    If not expunged, it will FOR SURE pop up immediately they punch your name in. You certainly can not lie there. You will be deported. If expunged, you still have chance BUT NOT to lie..If the form ask " If you have ever been arrested" say yes and as others suggested have all your documents ready from court but make sure you have all originals and notarized documents if required for all court orders pertaing to your case.

    Shoplifting crimes are usually prosecuted by state in which they are comitted. That render them state criminal case.

    I highly doubt they pull up state criminal record at POE.
    If its a federal crime, then i can believe that.

    However, this shouldnot encourage you to be dishonest at POE's or visa interview.

    I agree, you will be competing with all the illegals. But.....

    1. How likely are they to file their apps on the first allowable day that USCIS will accept the applications? Not very. Most of us know what's going on and will be ready to send in our apps first. Ofcourse if some EB based guy is pottering around instead of moving fast, thats his problem.

    2. How many illegals can afford the high priced attorneys? Most of these poor guys dont know to speak, read or write english, forget about filing out USCIS forms.

    3. How many illegals maintain perfect records of their time and can recreate a paper trail of the time they spent in the US. I certainly can and most legal wannabe immigrants can definitely prove the time they have been here (paystubs, utility bills, credit card statements, bank statements, etc.)

    The point I am making is - this is the best option I have seen in a long time. Even the stupid point based system had its drawbacks. This is unconditional. It will get vast support from the hispanic community also. The UK has the same thing. Be on a work permit for 5 years and then you are eligible to apply for Permanent Residency. I believe there is also some clause in the UK system that states that you have to have been in the UK illegally for 10 years as against 5 years for a legal immigrant. I'm sure setting the illegal bar at 10 years and legal bar at 5 would be acceptable for most people.

    If we reapply under this section, we will be competing with the massive illegal-to-AOS guys based on our Receipt date for adjudication.

    Senate Leaders Expect Immigration Bill Next Week

    WASHINGTON, May 11 � Senate leaders said today that they had broken a political stalemate and would bring to the floor next week an immigration bill that could put millions of illegals on the road to eventual American citizenship.

    An agreement reached today by Senators Bill Frist of Tennessee and Harry Reid of Nevada, the Republican majority and Democratic minority leaders, ends an impasse that has stalled action in the Senate for weeks while immigrants and their advocates have been holding huge demonstrations across the country.

    The deal does not mean that a bill will emerge from Congress soon. But it is significant that the Senate leaders agree to move forward, because the chamber operates under peculiar rules and traditions that can bury legislation indefinitely. Mr. Frist and Mr. Reid said they hope to schedule a vote before Memorial Day.

    Even if the Senate passes an immigration bill, it would have to be reconciled with a bill enacted in December by the House. That bill generally emphasizes border security rather than attainment of citizenship, so negotiations between Senate and House would probably be long and heated.

    "What the Democratic leader and I have laid out is a way to get on to this bill, and as you can tell, both of us are working in very good faith on the various issues that have been raised on the floor," Mr. Frist said.

    "I welcome the return of the immigration bill to the Senate floor," Mr. Reid said. "America's immigration system is broken, and our national security depends on Republicans and Democrats finding common ground to fix it. The assurances I have received from Senator Frist make me hopeful we can finally move forward on real comprehensive reform."

    The leaders' comments indicated that they had resolved the issue that had kept them apart: how many amendments to consider, and how much time to devote to them.

    "I didn't get everything that I wanted," said Mr. Reid, who blocked votes on amendments weeks ago, saying they were intended to gut the legislation. "I think the majority leader didn't get everything he wanted."

    Mr. Frist said there would be "a considerable number of amendments debated and voted on each day," and that they would be handled "in an efficient way."

    Until partisan bickering sidetracked legislation in the Senate in early April, the chamber was working on a package that offered opportunities for eventual citizenship, a guest worker program for some immigrants and measures to enhance border security. The tougher House ill focuses on border security and would crack down on illegal immigrants and those who employ them.

    Mr. Frist said 14 Republicans and 12 Democrats will negotiate with House members once the Senate passes an immigration bill. Seven of the Republicans and five of the Democrats will come from the Judiciary Committee, with the remaining negotiators to be picked by Mr. Frist and Mr. Reid.

    President Bush has said he favors legislation that would enable immigrants to become citizens, but only after they meet strict standards. He has said repeatedly that he does not favor "amnesty," a word that is anathema to many conservatives. "We congratulate the Senate on reaching agreement, and we look forward to passage of a bill prior to Memorial Day," Dana Perino, deputy White House press secretary, told The Associated Press.

    Senator Edward M. Kennedy, Democrat of Massachusetts, called the agreement announced today "a major step forward in our fight for tough but fair immigration reform."

    "Business and labor, Democrats and Republicans, religious leaders and the American people strongly support our plan to strengthen our borders, provide a path to earned citizenship for those undocumented workers who are here and put in place a realistic guest worker program for the future," Mr. Kennedy said.

    But quick passage is by no means assured, given the complexity of the immigration debate, the emotion it stirs and the approaching elections. Representative John A. Boehner of Ohio, leader of the House Republican majority, said in late April that he opposed the emerging Senate legislation and its emphasis on citizenship attainment. "I don't think that would be supported by the American people," he said.

    But the accord announced by Mr. Frist and Mr. Reid apparently means that immigration legislation will not sink out of sight in "the procedural quagmire that the Senate is," as Mr. Reid put it recently.

    Thanks for the feedback.. i will most likely be doing the same...wait for PP 140 to comeback and convert. I think its safer to work on a 3yr h1b than ead. But then while filing for h1b ext the dates must be retrogressed and not current.

    Need your valuable advice on this serious issue. Involved in shoplifting case, got arrested and plead guilty. Served the community service, and paid fine. Got the �Court Disposition Document� which states that I am all clear. My status is I-485 pending and have EAD, AP documents.
    1. Is it safe to travel to India and come back on AP?
    2. What are the possible chances that visa officer may not let me into the USA?
    3. Do I need to carry any letters from my criminal attorney explaining the situation?
    4. Any one in similar situation, please update me on this?
    5. Please list of documents I need to carry during my travel

    Please reply and post your valuable opinions/suggestions/advices.

    Guys,

    I keep hearing that "STEM will be exempt from the quota". What EXACTLY does that mean? Does it mean that:

    1) STEM's can apply for 485 straight away if labor is approved regardless of PD?
    2) STEM's still Cannot apply until PD is current, but after that no more waiting for the country quota

    May be you're right. for the benefit of the others, can you provide more info, and any basis for your statements. This would be useful information to have for a lot of affected individuals. Is there any reference to INA or CFR that one could look up?

    reality is, a contraction of US growth of this magnitude was never anticipated...there is strong fear of deflation!

    You have a little tricky situation at hand, but you'll be okay if what you wrote is true - Your employer will not revoke your pending I-140. Not only that, they have to be nice enough to respond to any RFEs that come for your case. they can state that the imimgration application they filed for you is for a future position.

    Also, USCIS has a guideline about these cases. They are supposed to see if your I-140 was 'approvable' if it had been adjudicated within 180 days or before you leave the company, which I think it should be.

    I understand there are some anxious days ahead for you, but If I had to bet, I would bet on successful result of your case in the end :).

    Just make sure that your old employer doesn't revoke your I-140

    BTW, when was your I-140 filed?

    The following is copied directly from a USCIS memorandum:
    "If the Form I-140 (�immigrant petition�) has been approved and the Form I-485
    (�adjustment application�) has been filed and remained unadjudicated for 180 days or more (as measured from the Form I-485 receipt date), the approved Form I-140 will remain valid even if the alien changes jobs or employers as long as the new offer of employment is in the same or similar occupation.1 If the Form I-485 has been pending for less than 180 days, then the approved Form I-140 shall not remain valid with respect to a new offer of employment."

    Looks like I-140 must be approved to use AC-21.

    Check ICICI. I think it is called a NRE account. You can fund it in Dollars and Rupees and it could be repatriated in Dollars. So just open the account and have them deposit the monies India, you can draw it here. This kind of account is for NRI's who earn an income in India and want to access it here.
    There is a limit I think but it must be like $25K..

    It is unlawful for an alien admitted on a non-immigrant visa to own a firearm(with one exception).
    So, if you want to own a gun, read on....

    The case where this 18 USC 922(g)(5)(B) was mentioned elaborately was United States vs ELRAWY.
    And it clearly is re-affirmed what is stated in the law on Unlawful acts(Sec 922) for FIREARMS, that '(g)It shall be unlawful for any person - (5) who, being an alien - (B) except as provided in subsection (y)(2), has been admitted to the United States under a nonimmigrant visa (as that term is defined in section 101(a)(26) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(26)));

    The case clearly notes that a person on Adjustment on status remains on the last admitted visa status until the Adjustment of Status is approved. So there is no ambiguity there.
    A person even after he has applied for adjustment of status can remain in the country, but for ownership of a gun, he falls back on his visa status.

    However, the law clearly states an exception for the person who is an alien that is on a non-immigrant visa - the (y)(2) part:

    (y) Provisions Relating to Aliens Admitted Under Nonimmigrant Visas. - (2) Exceptions. - Subsections (d)(5)(B), (g)(5)(B), and (s)(3)(B)(v)(II) do not apply to any alien who has been lawfully admitted to the United States under a nonimmigrant visa, if that
    alien is -
    (A) admitted to the United States for lawful hunting or sporting purposes or is in possession of a hunting license or permit lawfully issued in the United States;

    In short, apply and get a Hunting Licence from the State DNR., take the safety courses and then apply for the State firearm ID.
    And, if your licensing authority knows about this exception(hunting) in the law, they will issue you a license.
    If not, they will reject your application. If so, You might want to bring this section to their notice.
