Your good fight on the retrogression issue kind of kept us going without giving up. In just a few days what some of you have done with www.immigrationvoice.org is amazing and it truly deserves a lot better than the faint response they have got so far from all of us in this legal black hole. Honestly, I do not care if we are not able to raise 100K dollars for the lobbying efforts for the next immigration bill on February. I don not care if this money is finally lost. It will be money well spent if we all realize that we have to do something instead of waiting years and years and years� Any money is worth the effort regarding our goals, even if our present intention does not succeed. Is worth it!!. Lets move on, hoping for the best� It is worth to try this next immigration bill. Any money spent on this is worth it� Can not you guys see it? More and more years on this black hole!! More years paying our lawyers for H1B renewal, more years for renewal of our driving licenses, more years for our wives to wait, more years for our employers exploiting us� This next immigration bill could be our last chance in many years to get our unfair and sad situation known and probably solved. IT and BPO outsourcing is also leading to Americanization of Indian youth and Indian youth are spending their high salaries on American products. In no time you will see American fast food chains, groceries, and many American MNCs cashing on a Americanized Indian crowd and neutralize ( and will eventually exceed the investments they make).

Wait a minute here, if I was a cop, I would definitely judge this as DV. Unless, you absolutely had shut up to begin with. No chair, no drag, no nothing. which now has to be proved as misinterpretation.
And any offer that your lawyer brings you is trying to resolve the case, You are the one who should decide whether this case goes to trial or not.
Past peeing incidences, where the neighbours heard screams should be kept in mind.
And finally, take English lessons, dude, your written English too is very poor.
You can actually submit this as a proof that you were misinterpreted, if this goes to a Jury trial.
Also, please Delete any proof of the incidence, including the one posted here. No one shold be seeing the 100% truth, your 100% truth is scary.

IV has it's own lobbyists and has been using their services to get Green Card increases attached to various bills. Good lobbyists cost a lot of money like good attorneys. Though IV has hired the services of one of the top 10 lobbying firms, IV is limited by funds in utilizing their services. Most of IVs funding comes from few recurring contributors and other members who contribute one-time every now and then. Most of the money gets spent on these lobbying efforts.
There is a general tendency here to blame IV for not trying to attach increase in Green Cards to every immigration-related bill in the Congress, or not doing more lobbying. Members who blame IV need to understand the constraint of operating under limited funds and the necessity of making wise investments in only those efforts that are likely to yeild the most benefits like the Admin fixes campaign which has a better of chance of passing in an election year than the immigration-related bills.
If IV had more regular contributing members and more funds, IV would've tried to attach it's measures to more bills and we would've had a better chance of success. But sadly that's not the case. We need to appreciate that IV is doing the best it can under the circumstances.

The issue at hand is not whether the LC will get approved, that is relatively straightforward. It's whether an EB-2 I-140 will be approved based on a LC for a job zone 4 occupation.

Senate was interested in hearing the plight of a gay american citizen who could not live with his gay partner because his student visa was refused on reentry from Brazil and this gentleman couldnot sponsor him as a family member because the immigration act doesnt recognize gay partners as family members.
I suppose being a gay is going to be a much faster way to becoming a legal permanet resident rather than being a highly skilled indian immigrant.

I have a I131 (AP) renewal question. My first original AP was issued on Nov/2007. I understand that it expires in 1 year( I do not have the AP doc right in front of me right now). Also I traveled to Mexico in May 08 using AP and was stamped on AP as paroled until May 2009.
Is there a 120 day rule to file AP renewal (like the one for EAD)? Do I need to file for renewal of AP now (120 day before) or close to May 2009? I have filed for EAD renewal 1 month back and am still waiting for approval, will it cause any problems if I file for renewal while EAD renewal is pending?

(2) As employer is asking what they need to do - tell them they need to provide an AC21 letter of support - you can find various formats on the web.
(3) Your new job must be in same or similar category.
(4) Call customer service to verify your address on file - also hire a personal attorney and make sure they file g 28 and have them on file too for USCIS communication
(5) Your AC21 letter may/may not reach your file depending on the service center, officer and a lot of other factors.
(6) Usually most AC21 cases go through just fine unless your ex employer requests a revoke on i 140 - in such a situation you may get an RFE, NOID or a straight denial on 485 - nothing to worry about - you can resolve all these and you will find yourself back on track.

I recently purchased 250K term-insurance policy for $11.66 per-month from NY Life. I'm 30 yrs old and qualified for their top-level health rate (eating right and exercise has financial benefits !). I guess they are the only good ones who sell policies to H1. Also, my policy has terminal illness coverage meaning that they'll pay out the amount in-case of terminal illness even if I'm not dead. I have another 100K coverage from employer (no cost). I'm not covering 10 times my current salary but I'm calculating by using equivalent Indian salary and not US. I consider myself amply covered. Also, my policy will remain active even if I decide not to wait for GC and move to India.
Now my 2 cents about Term vs. Whole Life debate. It doesn't make any sense to buy whole-life at young age. But since the cost of term maybe prohibitively high at 60+ one should convert to whole-life at some point unless one can find/buy a fixed rate policy till 80 or something (plan to die a little b4 that :D )

I don't mean to sound dismissive, but I don't count as being a reliable source of information, since it is a tiny minority of total cases, and all information relies on user input - not the most reliable set of data, imho.
On the 1st page of "Country = india" and "case approved" there is 1 case that applied this year (feb eb2 with a PD of 02) - they were lucky. Everyone else applied before retrogression hit in 05 with the exception of a couple of eb2 with very old PD (00,01). 2 cases out of how many? 100s of thousands?

The number of available visas has not increased, the number of people that have applied for AOS has dramatically increased (either old or new PD). Some of you guys looks like confusing DISABILITY RIDER in the TERM/WHOLE policy with DISABILITY INSURANCE.
DISABILITY INSURNACE will pay for (in Most case 60% of the last salary) if you become PERMANENTLY DISABLED and can not work up to the age of 62 or 65. After that SS will pay for you.
DISABILITY RIDER that you have with extra cost in the LIFE INSURANCE policy cancel payment requirement of your Life Insurance policy. So If you become Disabled You WILL NOT HAVE TO PAY PREMIUM for your TERM/WHOLE Life policy and still it will be effective.
Because of my one of the diseases I am always worried about DISABILITY insurance.
I always try to get Short term and Long Term disability insurances through employer.
But the problem is they always start with long preexisting exlusions and when you change jobs they dont continue so have to start new one which also has other new preexisting exlusions to start.
You can convert your longterm disability to the personal policy if you have that for long time. but they are not valid if you get new job.

also do any of you know case where LIFE INSURANCE was actually paid and how easy/hard the process was for family?
Also similar experiences if some one know if any one used DISABILITY INSURANCE and how hard it was?

Assuming @gc28262 doesnt know this because of his personal experiences and exposure, do you guys think *all* consulting companies charge their employees money for the Visas? I know personally only those who doesnt charge. One of the consultants I know strives to differentiate himself from these. He provides benefits like in a large company.
One thing guys, if you know abuse and are silent because of any reason (could be you want your spouses/brother's H1Bs to go through or any reason), you are all guilty. So, dont try to be naive..
I dont want to tell anything about L1B because I dont know if there is anything illegal in anything companies are doing. First this is no slave labor. It is a free will employment. Just because somebody is ready to do some work for less, legally, you should not be worried too much. Instead of worrying about billing, try to upgrade yourselves to become better in skills, capabilities etc...your market value will automatically be upheld if not become more. Being an L1B myself, I dont see any single day I felt like I was abused or I am cheated by my company.
