My intention/question here is if an applicant is on H1 (most of the cases 5th or 6th yr of H1) and then loose the job and until he finds other job (has EAD but never used it) the applicant does not have payroll running during the break. then technically is he ok or does he has to maintain h1 status or does EAD protect him.
Coz until he finds a job and files for AC21 an applicant does not do any thing.
And what do you mean by satisfy AC21 criteria. unless you find a job you cannot file AC21....so during the gap (what is the status of this gap?...technically I am trying to find an answer. please point me to a link or document. If you are aware of it, else can IV find an answer to it)

EAD IS NOT A STATUS. EAD is given because you filed 485 and you are pending AOS, so you are permitted to stay till a decision has been made

Thats what my Question is......how i am gonna prove it i paid 3k for my H1. They are deducting 500 (for my H1) everymonth from my paycheck in the name of CASH ADVANCE DEDUCTION.
I really want to teach them a lesson....so that they stop messing many vulenerable people like me who go to them every year. Could somebody tell me how i am gonna complain DOL in new jersey about this company and does DOL really takes any action.

Well, in your case you don't have to prove anything, your employer has the burden to prove that he gave you "Cash Advance", which he didn't. He is the one deducting from your pay check. Deducting any amount from any pay check is a big deal and employers have the burden of proof. But that's the least of your worries. You are taking about "how will you prove". I am sure you can report this to US DOL and/or NJ dept of Labor. Given a choice, it would be better to report this to US DOL as foreign labor is in the jurisdiction of US DOL. If are willing to report your employer (whom I have many adjectives to describe), I will post the link to DOL website. In the past there were some post on this forum that said that the admin of this site could also help if you want to do something like this. Be ready to change your employer after you report to US DOL. You employer will be toast and will be debarred from filing H1s for few years (practically forever).

No, they count MS REQUIREMENT FOR POSITION as 4 yrs toward total SVP time according to that doc link I posted. These 4 yrs include 2 for BS plus 2 additional for MS. It is how they count. Nobody knows or cares how long it actually took you to get MS.

:confused:I am in same situtation. I want to reenter on AP and continue on H1-B. Can I do that? My company says its their policy that once I use AP to enter I will have to switch from H1-B to EAD. I dont want to do that. Can I still continue on H1-B?

My son was on H4 and joined undergraduate course in Canada last year. He is Canadian permanent resident too. As per July VB, I can file for I-485. My question is:
1. Can I and my wife file I-485 as AOS and file I-824 to change AOS to CP for my son, so that he may file I-485 as CP from US Consulate, Montreal, Canada?
2. If not, what are the options?

My company has offices in both canada(toronto and vancouver) and US .. i have worked for extended periods of time in canada. I agree that career development oppourtunities are limited due to economic reasons, but I there is no way toronto or vancouver can be considered "racist". And talking of high skilled workers, who said there is absolutely no discrimination in the US ? Isnt that what programmers guild and other labor unions are all about ? how come so many people support the blue collar illegal aliens (mostly meat-packers and lettuce pickers), but nobody cares about us, tax-paying, law-abiding highly skilled people ?
The difference is at least the canadian immigration policy doesnt institutionalize the discrimination by making us wait in limbo forever, unlike the US laws. At the end of the day, I would rather live with "limited career development" opportunity in canada and change employers at will than be surrounded by plenty of such opportunity but have my hands tied behind my back by the US laws.
As for "discrimination", we as immigrants always will have to bear with some discrimination,subtle or overt, from the native-born white collar workers whether in the US or anywhere else in the developed world. Our home country is the only one where you can expect to go and join the workforce without discrimination.

Section 11 has been created for you to tell them abt last EAD APPLICATION.
Keyword here is "application".
So in the Date I wrote the EAD application date and not the recept date.
This can be found on the last EAD receipt notice.
You are already sending them a copy of front and back of current EAD, where they can find on which date the EAD was approved etc.
Most cases Ideally current immigration status is "I-485 ADJUSTMENT OF STATUS PENDING".
I entered on an L1 5-6 years back. so I wrote manner of last entry as "TEMPORARY WORKER (L1)". Yes I have not reentered USA since then. Ha Ha.
My office mate reentered recently using AP and he wrote, also as per our lawyer, to use the word "PAROLEE"

The onus lies on you to do the needful not US Government or IV. I have known people who left their well established career to take care of their folks. You are looking for the solution to your problem on this message board, however you need not look this far. Enough said.

We are here because of our good parents. Forgetting them is most disrespect we do in life.
If we don't care our parents, when we become older(parents) how will our kids will care us?.
Research are proving...if we live together as family like in olden days...many health issues will disappear...everybody will be happy, no stress.
We need to go back to older family system. Now we are proving...green is better. food is medicine. So why not staying together with parents is not good?. This lead us to have a strong long lasting life.

What kind of charges may be filed under the following points?
1. Processing and approving 60K I-485's in 2-weeks (12 times normal speed) just to avoid the flood of applications in July, when you consider that their typical speed is around 10K/month. 25K applications were approved in just 2-days (37.5 times normal speed) over the last weekend.
2. USCIS requested visa numbers for cases where FBI background check was not completed. In other words, they requested numbers before processing could be completed for those cases and I-485s could be approved. Serious issue of lapse of national security here.
3. USCIS apparently approved I-485's of some people whose dates were not even current in June, even if their FBI check had been completed and I-485 otherwise ready for approval.
4. USCIS apparently approved I-485's of some people in July after DOS published the updated visa buletin on July 2nd advising that all visa numbers were exhausted for FY 2007.

Two of my friends relocated to India since the beginning of this year after spending 8-9 years and they had green cards too from 2004.
These guys had good jobs with a good pay but options in India were just much better to ignore.
Just food for thought for people who think that only in US can we make or break our life and careers. There are other places on Earth too where people live and be happy.

The agreement brokered by Senate Majority Leader Bill Frist, R-Tenn., and Minority Harry Reid, D-Nev., breaks a political stalemate that has lingered for weeks while immigrants and their supporters held rallies, boycotts and protests to push for action.
Key to the agreement is who will be negotiating a compromise with the House, which last December passed an enforcement-only bill that would subject the estimated 11 million to 12 million illegal immigrants in the United States to felony charges as well as deportation.
Frist said the Senate will send 14 Republicans and 12 Democrats to negotiate with the House, with seven of the Republicans coming from the Judiciary Committee and seven of the Democrats chosen by Reid.
Frist said a "considerable" number of amendments would be debated when the Senate begins debating the bill early next week.
It would be the most comprehensive rewrite of immigration laws since the so-called Simpson-Mazzoli bill some 20 years ago.
Reid acknowledged on the Senate floor Thursday morning that he "didn't get everything that I wanted" in the agreement, but said Frist didn't either. Reaching the agreement is "not easy with the political atmosphere," Reid said.
Reid had been taking some criticism for refusing to move forward on the bill after complaining that Republicans were trying to undermine it with amendments and insisting that Democrats be allowed to have a say in who serves on the conference committee.
Republicans, too, have had opposition from conservatives to the compromise proposal. These critics consider its path to citizenship provision for illegal immigrants and hundreds of thousands of future guest workers to be tantamount to "amnesty."
They've also had to contend with fallout from opposition to the House bill that triggered nationwide protests that drew hundreds of thousands in Los Angeles, Chicago and Dallas, and hundreds more in other cities and small communities.

People with grown up kids, I guess would prefer Canada over India. There are many problems starting with the education system, reservations etc. For kids who had been studying here from KG through grade 8-9 it's difficult to get dragged in the rat race in India, especially for normal kids who don't belong to any reservation category.
Yes in Canada we know that finding a job is going to be difficult and we should brain-storm about how to tackle this problem?
What skillsets are in demand? Anybody has idea?
I also have a wild idea like US companies may look at Canada as a outsourcing destination if given very competitive package. One of the biggest advantage will be proximity to the US, so better control over quality etc. That may not turn into a big boom but is a possibility.
I think the said "outsourcing" is already happening to a limited degree .. in fact many IT jobs in Canada are nothing but canadian offices of US firms. But it is never going to reach the extent of India or China, mainly because the savings in terms of cost are not as big.
The biggest problem I find with the canadian job market is limited demand for highly specialized IT skills .. so finding any job will not be a problem; but finding one commensurate with your qualifications and experience will be hard.Secondly, there are fewer tech centers than the US .. so one cannot afford to be too fussy about location etc. As far as I know, only Toronto and surrounding areas in Ontario would qualify as a "tech hub" in the US sense.
